It is a mandatory requirement for all businesses employing deemed workers in NSW and pay more than $7,500 per annum in actual wages. icare NSW runs several different insurance schemes on behalf of the NSW state government.

What is a Deemed Worker?

It’s Complicated!

A Deemed Worker is an individual who is “deemed to be a worker” for Workers Compensation purposes. This will include Full-Time, Part-Time and Casuals employees in your business. This will include Working Directors in your business, and in some situation's Independent Contractors.

When renewing your icare Workers Insurance Policy it is the obligation of the employer to include all relevant Deemed Worker remuneration a business has paid when declaring its Actual Wages.

Is a Working Director a Deemed Worker?

It’s Complicated!

If you are a Sole Operator and operating under an Australian Business Number (ABN) with an Australian company Number (ACN), and you pay yourself more than $7,500 in wages or dividends you are required to take out an icare NSW workers Compensation Insurance Policy. This will protect you in the event you suffer a work-related injury or illness.

Is a Sole Trader a Deemed Worker?

It’s Complicated!

If you are a Sole Trader, operating under your own ABN, and don't employ any other workers under your ABN you are exempt from an icare Workers Compensation Policy.

If you employ workers in your business under your ABN you may then be required to take out a policy to cover those workers.

You may also become a deemed worker under your Primary contractor's icare Workers Compensation policy.
